1. Introduction

We also strongly believe that everyone, including users, clients, partners, vendors, and website visitors follow the same. Pixelrasa has adopted a DMCA policy as per the prevailing and other relevant, evolving sections of the Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”), and other relevant, evolving laws to address copyright infringement claims. 

This DMCA Notice & Takedown Policy applies fully and unconditionally to the website www.pixelrasa.com and all related platforms, services, domain, subdomain, touchpoints, owned or operated by Pixelrasa.

2. DMCA Notice of Alleged Infringement (“Takedown Notice”)

A DMCA Takedown Notice with the undermentioned details may be sent to us if there is any instance of any piece(s) of information or content on our website or associated platforms infringing on your copyrighted work.

Required Information:

Please submit the following:

  • Distinguishing the copyrighted work(s) that has been claimed to have been infringed.
  • Contact information, including individual/organization name, organization, email address, mobile/contact number, and physical address.
  • Distinguishing the material that is allegedly infringing and is to be removed wholly or in part, along with specific URL(s) or location(s).
  • A detailed statement in good faith that the material’s use is not fully or partially lawfully authorized by the copyright owner, its agent, or the law.
  • A detailed statement that the notice’s contents are accurate, and under penalty of perjury, that you are the authorized entity or copyright owner.

3. Upon Receipt of a Valid DMCA Notice

Once we receive a proper DMCA notice:

  • Upon receipt of everything, we will initiate investigation of the alleged infringement.

     

  • We will investigate the alleged infringement.

     

  • If the contested material appears to infringe your copyright and is hosted by us, we will immediately disable or remove the material in question. Additionally, we may notify the content provider or user who originally gave us the material, providing them an opportunity to respond or defend with a counter notification.

4. Counter-Notification Procedure

If you are of the view that your material was disabled, blocked, hidden, or removed because of a misidentification or mistake, please feel free to submit a counter-notification. For this, we will require: your full name/organization, signature, email address, and phone number.

Distinguishing of the material disabled, blocked, hidden, or removed and the exact location at which the material previously appeared. Also, a statement under penalty of perjury is required saying that you legally believe in good faith that the material disabled, blocked, hidden, or removed because of mistake or misidentification.

A statement that you have fully and unconditionally offered your consent to the jurisdiction of the appropriate Indian court and are ready to unconditionally accept the process’s service from the original complainant.

5. Repeat Infringer Policy

Pixelrasa has the full and unchallenged rights in compliance with the DMCA and other applicable law to terminate fully or partially accounts of users or clients who are repeat infringers. We also reserve the exclusive rights to terminate access or accounts for even a single instance of infringement at our sole discretion.

The purpose of this document is informational in nature and it doesn’t constitute legal guidance or instruction. You may reach out to an attorney if you or your organization is accused of infringement or if your rights have been fully or partially infringed.

7. Abuse of DMCA Process

The deliberate or otherwise submission of misrepresented material facts or false claims in your counter-notice or DMCA notice may lead to legal and/or financial liability, including attorney fees, damages, and penalties.
